Booking Terms and Conditions

These Booking Terms and Conditions (“Terms and Conditions”) govern the contractual relationship between you (referred to as the “Charterer” or “you”) and Super Duper Catamaran Charters (“SDCC,” “we,” or “us”) for the skippered charter of the catamaran “Super Deux Purr” (referred to as the “Yacht”) in St Martin. By booking a charter with SDCC, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

  1. Charter Agreement
    1.1. The Charter Agreement is formed when SDCC receives the completed booking form and the required deposit payment from the Charterer.
    1.2. The Charter Agreement incorporates these Terms and Conditions and any other agreed-upon arrangements between the Charterer and SDCC.
  2. Booking Process
    2.1. To initiate a booking, the Charterer must complete and submit the SDCC booking form, providing all required information.
    2.2. A deposit payment, as specified by SDCC, must be paid at the time of booking to secure the reservation.
    2.3. Upon receipt of the booking form and deposit payment, SDCC will confirm the booking and issue a booking confirmation to the Charterer.
  3. Payment Terms
    3.1. The Charterer agrees to make the full payment of the charter fee to SDCC as specified in the booking confirmation.
    3.2. Failure to pay the outstanding balance by the due date may result in the cancellation of the booking, and the deposit may be forfeited.
  4. Charter Period
    4.1. The Charterer agrees to the specified charter period as indicated in the booking confirmation.
    4.2. The charter period includes the time for embarkation and disembarkation of the Yacht.
  5. Charterer’s Obligations
    5.1. The Charterer shall comply with all applicable laws, regulations, and customs of the cruising area.
    5.2. The Charterer shall be responsible for obtaining all necessary travel documents, including passports and visas.
    5.3. The Charterer agrees not to allow any person other than the agreed-upon passengers and the skipper provided by SDCC to board the Yacht.
    5.4. The Charterer shall be responsible for the conduct of all passengers and ensure they adhere to safety guidelines and instructions provided by SDCC and the skipper.
  6. Yacht Delivery and Condition
    6.1. SDCC shall deliver the Yacht to the Charterer in a seaworthy condition, fully equipped, and with all safety equipment as required by applicable regulations.
    6.2. The Charterer shall inspect the Yacht upon delivery and notify SDCC of any deficiencies or damages within a reasonable time.
  7. Cancellation and Refunds
    7.1. Cancellation by the Charterer:
    7.1.1. Cancellation requests must be made in writing. The date SDCC receives the cancellation notice will determine the applicable cancellation fees:
    – More than 5 days prior to the charter start date: Deposit may be refunded, minus administrative fees.
    – 5 days prior to the charter start date: 50% of the total charter fee is due.
    – Less than 24 hours prior to the charter start date: The total charter fee is due.
    7.1.2. If the Charterer finds a replacement charterer for the same charter period, SDCC may, at its discretion, allow for a refund or credit of the charter fee.
    7.2. Cancellation by SDCC:
    7.2.1. In the event of a major mechanical failure or unforeseen circumstances, SDCC may cancel the charter.
    7.2.2. In case of cancellation by SDCC, the Charterer will be entitled to a full refund of all payments made or offered an alternative charter period.
  8. Insurance
    8.1. The Charterer is strongly advised to obtain comprehensive travel insurance, including trip cancellation, medical coverage, and personal liability insurance.
    8.2. SDCC shall maintain insurance coverage for the Yacht, but the Charterer shall be responsible for any damage caused to the Yacht, its equipment, or third-party property resulting from the Charterer’s negligence or misconduct.
  9. Limitation of Liability
    9.1. SDCC shall not be liable for any loss, damage, injury, or delay resulting from acts of God, strikes, civil commotion, government restrictions, or any other circumstances beyond its control.
    9.2. The Charterer agrees to indemnify SDCC and its skipper against any claims, damages, losses, or expenses arising from the Charterer’s use of the Yacht, except in cases of SDCC’s negligence or willful misconduct.
  10. Governing Law and Jurisdiction
    10.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of the jurisdiction where SDCC is based.
    10.2. Any dispute arising from or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the jurisdiction where SDCC is based.
